Terms of Service

1. Acceptance of Terms

By accessing or using rvparksnear.me (the "Site"), operated by Pennsylvania Digital Solutions LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site. We may update these Terms at any time by posting the revised version. Your continued use after changes constitutes acceptance.

2. Description of Service

rvparksnear.me is an online directory of RV parks and campgrounds. We offer free browsing for travelers and paid listing services for park owners and advertisers, including subscription tiers (Free, Lite, Pro, Enterprise), premium listing add-ons, and display advertising placements.

3. Accounts

To access owner or advertiser features you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old to create an account. We may suspend or terminate accounts that violate these Terms or remain inactive for more than 12 months.

4. Subscriptions and Billing

Paid subscriptions (Lite, Pro, Enterprise) are billed on a recurring monthly or annual basis through Stripe. By subscribing you authorize us to charge the payment method on file at the then-current rate for your selected plan. Prices may change with 30 days' notice. Annual plans are billed in a single upfront payment.

Enterprise subscriptions are billed per park. Volume pricing (20% discount) applies automatically when three or more parks are enrolled under a single owner account. If a cancellation reduces the count below three, remaining subscriptions revert to standard Enterprise pricing at the next billing cycle.

5. Cancellation

You may cancel any subscription at any time through the Stripe Customer Portal accessible from your dashboard. Upon cancellation:

• Your subscription remains active until the end of the current billing period.
• At the end of the billing period your listing automatically reverts to the Free tier.
• All paid features (dofollow links, photos, booking buttons, priority sort, badges) are removed upon reversion.
• Active ad placement add-ons tied to the subscription are deactivated when the subscription ends.

We may cancel or suspend your subscription at any time if you violate these Terms, with or without notice.

6. No Refunds

All purchases are final. We do not offer refunds, credits, or pro-rata adjustments for any reason, including but not limited to:

• Partial use of a subscription period
• Cancellation before the end of a billing period
• Downgrade from a higher tier to a lower tier
• One-time purchases (Premium Listing, Newsletter Sponsor)
• Annual plan purchases
• Ad placement add-ons (recurring or one-time)
• Dissatisfaction with the service, traffic levels, or search ranking outcomes
• Account suspension or termination due to Terms violations

By completing a purchase you acknowledge and accept this no-refund policy. If you are unsure about a plan, we recommend starting with a monthly subscription before committing to an annual plan.

7. Failed Payments

If a recurring payment fails, Stripe will automatically retry the charge over a period of approximately two weeks. During this period your account will be marked as "past due" and you will receive an email notification. If all retry attempts fail, your subscription will be canceled and your listing will revert to the Free tier. We are not responsible for any consequences of failed payments, including loss of tier features or ad placements.

8. Ad Placements

Ad placement add-ons (Homepage Spotlight, State Spotlight, City Spotlight, Park Detail Sidebar, State Sponsored Grid, and display banner ads) are subject to availability on a first-come, first-served basis. We do not guarantee specific traffic, impressions, click-through rates, or conversion outcomes. Placement positions may change as the Site evolves. Ad placements require an active Pro or Enterprise subscription for park owners; if the underlying subscription is canceled, associated placements are deactivated.

9. Retail Advertising

Retail display advertising (Homepage Banner, State Banner, City Banner, Park Detail Banner, Route Corridor Package, Connectivity Sponsor, Newsletter Sponsor) is available to third-party advertisers. All ad content must comply with applicable laws, may not contain misleading claims, and must not promote illegal, harmful, or adult content. We reserve the right to reject or remove any ad at our sole discretion without refund.

10. Premium Listing

The Premium Listing add-on is a one-time purchase that enhances your park's directory entry with AI-generated editorial content, a "Premium" badge, and priority sort above standard listings. The content is generated based on publicly available information and may not be fully accurate. You may request corrections by contacting us. The Premium Listing designation is permanent and non-transferable.

11. Listing Content and Accuracy

Park data on the Site is aggregated from public sources including the Recreation Information Database (RIDB), OpenStreetMap, and user submissions. We make no guarantees about the accuracy, completeness, or timeliness of any listing. Park owners are solely responsible for the accuracy of information they submit through their dashboard. We reserve the right to edit, remove, or revert any content that we determine to be inaccurate, misleading, or in violation of these Terms.

12. SEO and Dofollow Links

Paid tiers (Lite, Pro, Enterprise) include a dofollow backlink to your website. While dofollow links generally pass SEO authority, we make no guarantees regarding search engine rankings, domain authority improvements, or any specific SEO outcomes. Search engine algorithms are controlled by third parties and are beyond our control. The dofollow attribute is applied immediately upon upgrade and reverts to nofollow if your subscription lapses.

13. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose
• Claim ownership of a park you do not own or operate
• Submit false, misleading, or deceptive information
• Scrape, crawl, or collect data from the Site without written permission
• Interfere with the Site's operation or other users' use
• Circumvent subscription restrictions or feature gates
• Manipulate reviews, ratings, or engagement metrics
• Use automated systems to interact with the Site without authorization
• Reverse-engineer, decompile, or disassemble any part of the Site

14. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, is the property of Pennsylvania Digital Solutions LLC or its content suppliers and is protected by United States and international copyright laws. User-submitted content (reviews, tips, photos) remains the property of the submitter, but by submitting you grant us a perpetual, royalty-free, worldwide license to display, reproduce, and distribute it in connection with the Site.

15. Disclaimer of Warranties

The Site and all services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Pennsylvania Digital Solutions LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising out of or in connection with your use of the Site or these Terms, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Site shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

17. Indemnification

You agree to indemnify, defend, and hold harmless Pennsylvania Digital Solutions LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Site.

18. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Franklin County, Pennsylvania. You consent to the personal jurisdiction of such courts and waive any objection to venue.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pennsylvania Digital Solutions LLC regarding the Site and supersede all prior agreements and understandings.
